Life Insurance Company Paying The Wrong Person? Why You Need An Expert Now

“We know this is a difficult time for you” the life insurance company writes. But then they write something to make things even worse: that you are “not” the beneficiary, or that someone else who should never be the beneficiary, is the person they are going to pay. What a shock! How can this be? What is going on?

These are called “Beneficiary Disputes”, and we are experts in resolving these matters.

Many times, our clients tell us that the life insurance company refuses to even tell them who is the “beneficiary” or anything else on the policy. This can even happen for a child on a parent’s policy, or a spouse on their own spouse’s policy. What is going on when a life insurance company is about to pay the wrong person?

The life insurance company doesn’t really want to decide who should get paid. The life insurance company wants to follow written instructions – the “Beneficiary Designation” or the paragraphs of the life insurance policy that have an order of payment. Sometimes, if a beneficiary is designated, but then themselves dies, the life insurance company may want to pay the beneficiary’s heirs – who may not be the same as other people more closely related to person with the life insurance who just died.

We have seen cases with multiple Beneficiary Designations, sometimes with portions to various people. It is a factual question, not opinion, whether the life insurance company actually received the various designations.

If the life insurance policy has disputes between possible beneficiaries, sometimes the life insurance company will sue everyone in an Interpleader action. This puts the life insurance policy benefits into the hands of a Judge, often a United States District Court Federal Court Judge. This is a regular lawsuit, but in Federal Court. Many lawyers are unfamiliar with Federal Court, which has its own rules. This can get complicated, very quickly.

Have you suffered the unexpected loss of a loved one, only to have a claim for life insurance benefits delayed, or denied? Do you get the feeling that the life insurance company is doing everything it can to avoid paying the claim? Has the life insurance company sent you a letter stating that they are rescinding the policy, making a rescission, or just sending back the premiums paid? Especially if your loved one had the policy for less than two years before passing away, the life insurance company can become very aggressive at seeking to avoid the policy payment. Rescission is a favored strategy of the life insurance company, if the policy was issued less than two years before the death.
