“In 2009, Guardian was the subject of controversy when, in December 2008, it cancelled the insurance plan that covered Ian Pearl, who suffers from muscular dystrophy and requires 24-hour nursing care, which costs approximately a million dollars a year. Under the federal ERISA law Guardian was obligated to continue the coverage for one year after it cancelled the plan and thus policy under the plan. Guardian offered no comparable plan to replace it, and his parents characterized the cancellation as a “death sentence.”

His parents sued Guardian and lost the case in October 2009, when a federal judge found that Guardian had the right to terminate the entire plan. The Pearl family appealed to the Secretary of Health and Human Services and to the media, and publicized a memo that emerged during the trial, which characterized high cost policies like the one Pearl had, as “dogs” and “trainwrecks.” Guardian publicly and personally apologized to the Pearls and agreed to continue coverage for Ian and two other patients in similar situations.  Ian Pearl lives in New York State, and as a result of the controversy, New York passed “Ian’s Law” that among other things, requires that insurance companies that cancel insurance plans must offer similar replacement coverage to policy holders under the cancelled plan”.

Endless investigations.  Do you feel that the life insurance company is just asking one question after another, and that the investigation never seems to end?  These endless investigations show that the life insurance company has already quietly decided to not pay, and is looking for an excuse, or to wear you down.   The life insurance company has the duty to properly investigate the claim and keep you informed of the status of your life insurance claim investigation.  That means information about what is being investigated, and what you can do to help.  If you ask a claims adjuster for a status update only to hear, “The investigation is ongoing” without any details, the claim is being wrongfully delayed.   If there are no specific reasons for an unusually lengthy review, you owe it to yourself to consult with a life insurance attorney, now.

Coverage questions:   Sometimes the life insurance company is looking for just a specific fact, to use to exclude coverage.  These are trickier claims, because they involve the application of facts to the full terms of the life insurance policy.  With our 30 years of life insurance litigation experience, this is something that we can do very well for you.  Mistaken coverage issues usually result in denials of coverage.  That means claims denial.  The many California laws and reported cases are very complex and offer many grounds for us to argue for coverage, on your claim.  This is not territory to go into without the most experienced life insurance lawyers.

Examination Under Oath (EUO).  The EUO is a formal proceeding taken under oath in front of a court reporter, similar to a deposition, but with possibly fewer legal rights.   An EUO can be a very intimidating situation–don’t believe a life insurance company that says you don’t “need
a lawyer for it.  An EUO is conducted when the insurer requires additional detailed information from the policyholder in order to make a coverage or claims decision.   You may not even understand the reasons for the detailed questions–that is another way the life insurance company has the upper hand.  For the wrong life insurance company, an EUO’s can also be used in wrongful claim delay, as an excuse to delay and eventually deny a claim.   If you have been asked to attend an EUO, you need to get a life insurance attorney on your side, starting with a for a free consultation.

Referral to the Special Investigations Unit (SIU).  SIU referrals are an investigation on an intense level, by people who are often ex-police, looking for insurance fraud.  If your claim is in SIU, you better lawyer-up.  SIU investigations can be very intimidating, which is a way of getting people to give up.  But the same rules of investigation apply–a life insurance company has to look for evidence to pay the policy, too, not just deny.

Especially if you have a national or ethnic heritage that is “suspect” by many life insurance companies, which may automatically put you under special investigation, it is unlikely that you will get your policy paid without legal services.
